In May 2016, Kinner was sentenced to 11 years in prison by Butler County Common Pleas Judge Keith Spaeth who had the option of imposing a sentence of three to 11 years.
On appeal, Kinner argued the judge erred in sentencing her to the maximum because proper factors were not considered.
In an unanimous decision, the appellate judges disagreed with Kinner’s argument.

“The trial court considered the purposes and principals of sentencing as required by (state law),” according to the decision. ” The trial court noted the seriousness of the offense, as well as Kinner’s series of bad choices that led to the child’s death. … The child had multiple injuries that Kinner did nothing to stop. Kinner knew her boyfriend smacked, shook and punched the child and she did nothing to stop it. Moreover, Kinner waited until the child stopped breathing to call for medical help.”
Young is serving a 15 years to life in prison after being found guilty of murder following a jury trial.
