What started as a petty theft complaint became more serious when the alleged thief struggled with an Oxford police officer and punched him in the face, according to a police report.

The initial report of the theft of a blue bottle of Bacardi liquor from the Colony Food Mart on College Corner Pike brought an officer to the store at 6:45 p.m. Feb. 20.

The officer was shown video of the theft involving a white teenaged male wearing a blue t-shirt and blue gym shorts going to the store’s cooler and walking out with the bottle of liquor.

A woman entered the store and told an officer the suspect, known to her as “Nicky,” was across the street.

Officers responded to that location to see a resident of the apartment building holding the suspect down on a second-floor balcony. The officer told the suspect to relax and stay there, but he attempted to get up and pulled away from the officer.

In the struggle to control him, the suspect punched the officer in the face with a closed fist. He was taken to the ground by a punch to the ribcage by the officer. The two officers then handcuffed him.

The suspect continued to thrash around and spit on one of the officers.

He continually threatened to kill the officers, saying he would murder them and, “You’re dead, officer on my back,” and “If I see you again, you’re dead.” He also reportedly told them, “If you love your life, love your family, you’ll let me go.” Asked if he was threatening them, he replied, “I’m threatening to kill you,” according to the report.

Due to his violent behavior, he was placed in leg restraints and administered a sedative medication.

He was identified as Nicholas William Vergis, by his mother, Michelle Vergis, 46, who arrived on the scene but reportedly had to be told multiple times to stay down the stairs from the incident but she continually tried to climb the steps and was agitating him more, according to the report.

When the medical team attempted to remove Nicholas Vergis on a stretcher, she interfered and refused to move out of their way. After numerous warnings, she was placed in custody and taken to the police station. She was charged with misconduct at an emergency and released on her own recognizance.

Nicholas Vergis, 19, was taken to Fort Hamilton Hospital and warrants were issued for his arrest on charges of assault, two counts of retaliation, theft, offenses involving underage persons and resisting arrest.
