‘Illegal adoption contract’ lawsuit against Butler County lawmaker set for trial

A civil case against Ohio Rep. Sara Carruthers will go to trial in August 2020 after a Hamilton County judge last month denied Carruthers’ motion to dismiss the lawsuit in which she’s accused of an “illegal adoption contract.”

Jamie Robinson, of Hamilton County, claimed in her lawsuit filed in February that Carruthers, a Hamilton Republican state lawmaker, failed to live up to a promise that she would provide Robinson a home in exchange for giving up her twins for Carruthers to adopt.

Robinson said in her complaint that Carruthers reaffirmed a promise made in a March 2018 phone conversation which “brought back, literally, the wounds of the past,” causing her to “relive the entire ordeal.”

Carruthers’ attorney, Richard Hyde, filed a motion to dismiss in March, claiming it was a “frivolous” suit, but Hamilton County Common Pleas Judge Melba Marsh denied that motion.

Carruthers won election to the 51st Ohio House District in November 2018.

A pair of conference calls among the attorneys and the court were scheduled last week and on Tuesday, June 4.

Among other allegations in her complaint, Robinson claims Carruthers breached an oral contract and “made promises … to induce her into not disclosing an illegal adoption contract.”

The lawsuit’s allegations include fraud, breach of oral contract, promissory estoppel and intentional infliction of emotional distress. Robinson claims Carruthers is liable for more than $480,000. She claims Carruthers promised in March 2018 she would “make good” on promises made in 2007 and 2008.

Robinson’s attorney, Christopher Wiest said the attempt to dismiss, and trying to seek sanctions “is just the latest effort by Ms Carruthers decade-long scheme to bully my client.”

Hyde declined to comment on the case.

Carruthers, in a prepared statement earlier this year, called the lawsuit “heinous,” and said it “would be detrimental to her children.” She also claims Robinson is attempting to “extort money” from her and she “will not be bullied.”
