A Montgomery County judge has thrown out evidence against a man arrested on gun charges in an order saying the Dayton police officers “staged” their justification for pulling him over.

An ex-Talawanda School District aide arrested last month for endangering a child has waived her right to a speedy trial and will not face a judge again until March, according to court records.

Heather Keller, 37, was charged with first-degree misdemeanor in December following an investigation by the Butler County Sheriff’s Office.

Keller is accused of knowingly abusing a child with a mental or physical disability, according to the complaint filed by Detective Eric Partin. The Dec. 12 incident happened at Bogan Elementary School.

The complaint states the incident was caught on camera and is part of the evidence.

Keller allegedly, “grabbed the victim multiple times by his face and neck area and pushed his head into the back of his wheelchair,” Partin wrote in the complaint. “(Keller) also pulled his left arm across his face and under his chin while applying pressure with both of her arms. (Keller) also flicked him in the face with her finger.”

Defense attorney Matthew Fritsch filed a motion for a continuance of Keller’s Thursday court appearance in Butler County Area I Court stating time was needed “to permit the opportunity to engage and review the discovery materials and conduct a pretrial conference with the prosecutor.”

Fritsch also indicated Keller has waived all time requirements.

The continuance was granted, and Judge Rob Lyons reset the hearing from March 6.

Keller is free on $5,000 bond.

The district was pursuing termination, but Keller resigned prior to the district’s scheduled disciplinary hearing, the district said.

“Talawanda does not condone the use of inappropriate or excessive student physical contact.” according to the district.
