Trial continued for Oxford taxi driver accused of sexual assault

The trial of a man accused of sexually assaulting two Miami University students in his vehicle, which he used as a taxi, has been continued until May.

W. Sherman Jackson II’s trial is now scheduled to begin May 14 in Butler County Common Pleas Judge Keith Spaeth’s courtroom.

Jackson II, 38, the owner and operator of Sherman’s Safe Ride, is charged with three counts of rape and three counts of sexual battery involving two women. He pleaded not guilty of all charges and is free on bond.

Two women filed separate reports with police accusing Jackson, of College Corner Pike, of sexually assaulting them in his vehicle, according to Oxford police.

Last week, following a hearing, Butler County Common Pleas Judge Jennifer McElfresh ruled against the defense’s motion to suppress evidence, condom and condom wrappers, seized in a search of Jackson II’s vehicle. Because Spaeth signed the search warrant, he could not rule on the defense motion.

But last month Spaeth did suppress some of the evidence taken from the defendant’s body.

The judge ruled the evidence from Jackson II’s genitals could not be used in court, but evidence swabbed from his mouth was not suppressed.

Defense attorney Chris Pagan contended that Jackson shouldn’t have had his naked body examined by a female sexual assault nurse in the Oxford police department booking room.
