According to court documents, the prosecution is not disclosing to the defense the name of certain witnesses until just before trial because the disclosure may compromise the safety of the witnesses.
“The State of Ohio has reason to believe the defendant committed the act due to his belief that an associate of persons residing at the (house) had committed a theft from the defendant,” a prosecutor wrote in the document.
The prosecutor said five witnesses have legitimate fear for their safety based on the brutal nature of the crime and information that “defendant has told people, including some of the undisclosed witnesses, that he has ties to the cartel and has people he can call to take care of ‘problems.’”
Police were called shortly after 9:30 p.m. on Nov. 21 to a report of a child shot inside the home.
When they arrived, the 22-month-old gunshot victim was being driven by her mother to Cincinnati Children’s Liberty Campus in Liberty Twp. From there, the child was transferred to Cincinnati Children’s Hospital Medical Center in Cincinnati. The children have been discharged from the hospital.
According to neighbors, a man drove by the house twice and shot multiple times.
