Tracy Moore, 45, was indicted in April by a Butler County grand jury on the second-degree felony charge as well as a lower felony charge of vehicular homicide.
His case has been continued several times, but last week Butler County Common Pleas Judge Noah Powers II set trial for Oct. 17.
Moore is free on bond.
On Oct. 20, 2017, the concrete bucket truck driven by Moore was traveling west on Ohio 129 near Fair Avenue when it rear-ended the SUV driven by Deanna Gilreath, 58, of Hamilton. Gilreath’s Jeep Liberty burst into flames and she died at the scene.
A Hamilton police investigation indicated Moore’s license was under suspension at the time of the fatal accident. Moore was driving a truck from Tri-State Concrete located in Hamilton, according to investigators.
The bill of particulars filed by prosecutors says that Moore “recklessly caused the death of Deanna Gilreath while operating a motor vehicle while his license was under suspension and knowing the vehicle’s brakes were not functioning properly.”
The truck was estimated to have been traveling 65 mph when it struck Gilreath’s SUV, according to police. The posted speed limit on Ohio 129 at Fair Avenue is 35 mph.
