Boggs had slurred speech and bloodshot eyes and was unsteady on his feet, according to a police report. He told police he had one Four Loko several hours earlier and had gone to get more.

Boggs agreed to submit to field sobriety tests but performed poorly. During a Walk and Turn test, he reportedly told the officer, “I can’t do this. I think we all know why.”
The officer asked if it was due to being intoxicated and Boggs replied, “Yep,” according to police.

Boggs was taken to the police department, where he produced a breath test reading of .248. He was given an administrative license suspension and his license was taken to be sent to the Bureau of Motor Vehicles.
In addition to the OVI charge, he was also charged with failure to yield right of way when turning left.
