Butler County man accused in child porn case asks to travel for work in family’s trucking business

A hearing challenging the legality of 11 search warrants in the investigation of a Madison Twp. man charged with 101 felony counts involving child pornography has been rescheduled for July.

Trevor Fraley, 24, of Dickey Road, was indicted in November on multiple counts each of pandering sexually oriented matter involving a child and illegal use of a minor in nudity-oriented material or performance.

Fraley has pleaded not guilty to all charges. The hearing was scheduled May 29 in front of Butler County Common Pleas Court Judge Michael Oster Jr., but it was continued until July 30 due to coronavirus concerns.

Fraley is free on $500,000 bond and is fitted with a GPS monitor. As part of bond, Oster also ordered Fraley to have no contact with any children, including his own, to have no internet access and to report twice per week to pretrial services.

But Fraley is requesting a change in that bond to allow him to work and pay his attorney

Last week, attorney Chris Pagan filed a motion to modify bond to permit Fraley to travel for work in more surrounding counties.

Fraley’s family owns a Butler County trucking company, and he can work for that company, but it would require traveling through Preble, Montgomery, Greene, Miami and Clark counties to get to a customer in Springfield, according to Pagan.

“His bond would require adjustments for the GPS to track him to those counties,” Pagan said.

Assistant Butler County Prosecutor Kelly Heile filed a motion in response saying the prosecution does not object to Fraley traveling for work in the additional counties with limitations.

“The state does, however, object to the defendant’s unfettered ability to travel within the additional counties,” Heile said in the the motion.

The prosecution requests Fraley be required to provide to the GPS monitoring personnel a work order and travel itinerary that includes location and stops along the way prior to the trip so his movements and purpose can be monitored and verified.

As of Monday, Oster had not yet ruled on the bond modification request.

In March, Pagan filed a motion to suppress evidence taken from a Crawford Street home, cellphone, computers and other electronic devices.

Pagan argued some of the search warrants were not properly signed by the magistrate and relied on an uncorroborated statement from a woman with a drug addiction and a case through Butler County Children Services.
