With several exceptions, the proposal seeks to control sounds “generated at any premise to which a D permit has been issued (by) the division of liquor control or that is generated within any area zoned for residential use,” township records show.
A class D permit is known as a full-service license that includes the sale of beer, wine, mixed drinks and liquor until 2:30 a.m. and on Sundays, according to the state.
“We’ve had recurring noise complaints for years in certain areas of the township, as well as for trash collection in the overnight hours in many subdivisions,” Clearcreek Twp. Administrator Matt Clark told this news organization.
Trustees are “being responsive to our citizens’ desires to exercise their regulatory allowances” under Ohio law.
Violators face a second-degree misdemeanor, according to the proposal. First-time offenders will be fined $100.
Repeat violators in a calendar year face the following penalties: Second offense, $250; third, $500; fourth and beyond, $1,000, township records show.
Exemptions to the proposal include the following sounds: warning or alarm devices and safety signals; emergency vehicles responding to a call; those at government-sponsored or authorized special events; the normal use of churches, schools, athletic fields and parks; power tools, landscaping or yard maintenance tools, equipment or motor vehicles; construction tools and equipment; hunting, trapping or fishing activities, or the use of firearms; and fireworks during any state recognized days.
The township is set to meet at 5:30 p.m. Jan. 13, at which time public feedback will be considered.
