Dylan J. Busam, 25, was arrested at the Middletown police station about 1:15 p.m. Friday and charged with murder and aggravated robbery, according to police. Bond was set Monday by Judge James Sherron at $1,250,000 cash, surety or property.
Mykael Callahan, 29, was shot multiple times, according to Warren County Coroner Dr. Russell Uptegrove.
Officers were dispatched to the 3700 block of Lacy Court about 7:30 p.m. Thursday and found Callahan on the ground suffering from multiple gunshot wounds.
Busam and Callahan arranged through social media to buy $25,000 worth of THC products from a 21-year-old Indiana man, according to police.
The Indiana man arrived on Lacy Court for the transaction. Busam got in the front seat and Callahan in the back. Busam took the man’s phone and wallet, then Callahan walked to the back of the car with the man, according to police records.
According to police, Callahan pointed a gun at the man and said, “Don’t make a move. I will pop you, you just drove two hours for nothing.”
While the two men scuffled over the gun, Busam took boxes out of the Indiana man’s vehicle and put them in a vehicle known to them at the scene.
After the boxes were loaded, Callahan put the gun in his hood. Then the Indiana man “pulled a gun on Mykael and stated ‘you are not taking my stuff.”
“At this time, Callahan pulled his gun and the (Indiana man) stated that he shot several times,” according to court documents signed by Detective Kristi Hughes.
Busman is charged with murder because under Ohio law, if you are involved in a crime that results in the death of another person you are subject to being charged with responsibility of the death of that person, according to prosecutors.
“If you are engaged in conduct that is a felony and it is violent behavior and somebody ends up getting killed in the process, even if it is one of the partners in crime, you are going to be held responsible for that death,” said Butler County Prosecutor Michael when explaining a similar case last year.
